1. CONTEST: Mentos 360° game
1. Mentos 360° game Contest (hereinafter referred to as ‘Contest’) is an online game hosted on 360game.mentosindia.com/mentos360/ wherein the eligible participants need to search for objects in a 360° game environment of Mentos 360° game application in the shortest time possible.
This contest is conducted by
Perfetti Van Melle India Private Limited (hereinafter referred to as ‘PVM India’) having its registered office 47th Milestone Delhi – Jaipur Highway, Manesar 122050 , Gurgaon (Haryana) and corporate office at 1st Floor ,Tower A, Global Business Park, MG Road, Gurgaon – 122002 (Haryana) through its agency Eccentric Engine Private Limited (hereinafter referred to as ‘Agency’), being the digital agency having its office at 101/102, Kshitij Building, Opp. Andheri Sports Complex, Veera Desai Road, Andheri (West), Mumbai - 400053. Before participating in the Contest, please read the terms and conditions given herein.
2. Contest Period: The Contest shall commence from 13 th December, 2016 at 6:01 P.M. and conclude at 8:00 P.M. on 05 th January, 2017 , (hereinafter referred to as ‘Term’).
3. Any entry for the Contest before 13 th December, 2016 at 6:01 P.M. and conclude at 8:00 P.M. on 05 th January, 2017 shall not be entertained and summarily rejected.
4. Eligibility:
(i) Participant(s) must be a citizen of India; residing in India. Residents of other countries and non-resident Indian citizens are not eligible to participate.
(ii) The Employees, agents, associates and promoters of PVM India and of its affiliates, subsidiaries and advertisement agencies (including their immediate family members) and all others directly associated with organising the Contest(s) are not eligible to participate.
(iii) The contest is valid for all the registered users (“User”) of www.facebook.com or www.google.com or www.twitter.com or has a valid email address account.
(iv) Participants need to sign up for the contest by allowing Mentos 360° game application’s (hereinafter referred to as ‘application’) request for access of his/her account on the www.facebook.com or www.twitter.com or www.google.com or by clicking on the confirmation mail link send to the users email address if the user registers in the contest via his / her e-mail. Mentos 360° game application is hosted on 360game.mentosindia.com/mentos360/
(v) By allowing the participant’s request for the permission access, the participant allows the application to access his/her personal information including but not limited to name, location, Email id, gender and any other information present in his/her account on www.facebook.com or www.twitter.com or Google + profile or www.google.com or his/her email address if an e-mail address has been used for sign-up.
5. No purchase of either Mentos or any other product sold by PVM India is required to participate in the Contest. No charges are payable to PVM India or the organisers to participate in or win the Contest. The Contest is not being conducted with a view to earn profit or promote the business or sales of PVM India and is intended to invoke interest in product advertisement.
6. To participate in the Contest, the participant (the “Participant (s)”) must :
(i) Must sign-up for the contest by allowing Mentos 360° game application’s (hereinafter referred to as ‘application’) request for access of his/her account on the www.facebook.com or www.twitter.com or www.google.com or by clicking on the confirmation mail link send to the users email address if the user registers in the contest via his / her e-mail.
(ii) The contest (hereinafter referred to as ‘Contest’) shall ask participants to search for objects in a 360° game environment of the application in the shortest time.
(iii) A user can participate in the contest as many time as he wishes to, but only the first three attempts of the participation by the participant will be considered towards establishing the shortest possible time in which the contest was completed by the participant. (i.e. best of three attempts of participation).
(iv) Out of all the eligible entries received, top 16 sixteen entries (arranged in ascending order of time in which the contest was completed) will be considered for prizes*.
For easy reference of the Participants, steps on how to make an entry in the contest is enclosed as Annexure I.
7. There will be at a maximum of 16 prize* winners during the Term of the Contest. The prize will be as under:
i. Flipkart Rs. 25000/- (Rupees twenty five thousand only) voucher for one winner and Flipkart Rs.4000/- (Rupees Four Thousand only) voucher for each of the 15 winners. This is further elaborated under:
a. The participant ranking the first when all the entries are arranged in ascending order of time in which the contest was completed will be eligible for a mega prize of Flipkart Rs. 25000/- (Rupees twenty five thousand only) voucher.
b. Remaining 15 entries will be eligible for a prize of Flipkart Rs.4000/- (Rupees Four Thousand only) voucher.
ii. For redemption process & Terms and conditions binding the redemption of the coupons please refer to the website “ www.flipkart.com ”
iii. The final gifts will be delivered by PVMI or its agency within two month from the day of announcement of the results
* PVM India reserves right to change the Prizes/value of the Prizes, without providing any prior notice to the Participants.
8. The criteria for selection of winners will be as follows:
(i) A user can participate in the contest as many time he wish, but only the first three attempts of the participation by the participant will be considered towards establishing the shortest possible time in which the contest was completed by the participant. (i.e. best of three attempts of participation)
(ii) Out of all the eligible entries received, top 16 sixteen entries (arranged in ascending order of time in which the contest was completed) will be considered for prizes.
(iv). The entries submitted by the participants will be judged by PVM INDIA and/or the Agent basis point 8(ii) and that participants are not entitled to any clarification from PVM INDIA and/or the Agent in regard to selection of the winners.
9. The selected winners will receive a message from authorized representatives of PVM INDIA and/or Agent asking them to provide their contact details. Any delay, in providing the requisite details, for more than 48 hours form the time of contact to the participant by PVM INDIA and/or Agent shall provide discretionary authority to PVM INDIA and/ Or Agent to consider another entry as a replacement prize winner.
Note: Participant(s) recognised as a winner(s) once, shall not be eligible for any of the subsequent prizes during the Term of the entire Contest.
10. Entries will be submitted only according to the procedure described in these terms and conditions. Entry submitted through any other mode/platform shall not be eligible for the prize/s mentioned herein.
11. The decision of agency/PVM India shall be final, binding and non-contestable.
12. The tentative dates and timings for declaration of prize winner(s) are as per below schedule: 12 th January 2017 to 22 nd July 2017
13. The Prize Winner/Winners for Contest will be notified by PVM India or its Agency on the Mentos India Facebook page in the comments section of the video post introducing Mentos 360° game and photo post introducing the Mentos 360° game along with a direct message (DM) being sent to the registered and signed-up (Reff. Pt 6 (i)) accounts of the selected winners on www.facebook.com or www.twitter.com or www.google.com or Google+ or Email address.
The Winners need to respond to the DM and share their details asked in the DM (Ref Point 9). PVM India and its agents or representatives will use their best efforts to contact the prize winner(s). PVM India/Agency shall not responsible in any manner whatsoever in regard to Contest and/or for non-receipt of any communication due to network failure, network congestion, network unavailability or any other technical issue or event/incidence not within the control of PVM India/Agency.
In case the prize winner for a Contest cannot be contacted even after 7 days of attempted intimation, the selected prize winner will stand disqualified and PVM INDIA and/ Or Agent shall have discretionary authority to consider another entry as a replacement prize winner.
If the original Prize Winner for a Contest is disqualified for any other reason, such as being found ineligible or indulging in fraudulent practices or failing to comply with terms and conditions mentioned herein, PVM INDIA and/ Or Agent shall have discretionary authority to consider another entry as a replacement prize winner.
14. The prize(s) will be awarded to the prize winner(s) after due verification and in accordance with the terms and conditions stated herein. The prize winner(s) shall, prior to collection of the prize, will be required to submit to PVM India or Agency, valid ID proof, residence proof, PAN and/or any other document as specified by PVM India/Agency. The participant agrees to submit an affidavit in the prescribed format as to satisfying all the terms and conditions, tender evidence, if so required by PVM India. For valid ID proof as well as residence proof, any two of the following may be submitted:
a) Passport, b) Voter ID c) Driving License d) UID/Aadhar Card e) Nationalised bank passbook with PVM India reserves its right to waive/relax any of the above documentation requirements as it may deem fit.
15. The cost and expenses incurred towards conducting and administering the Contest are being borne by PVM India out of its own funds and same are not being recouped in any way from the Participants. However the prize winner for each Contest shall be liable for income tax, levies and duties due and owing under applicable and statutory laws in connection with the prize(s). All other costs, expenses including travel expenses, cost of delivering etc, insurance, transfer fees, registration fees that may be applicable to avail/use/the prize(s) will be borne by the winner.
16. The prize(s) are non- transferable and non-negotiable. The Participants understand that the prizes are on "as is" without warranty of any kind, either express or implied, including but not limited to, merchantability, durability, suitability for any particular purpose, performances and/or non-infringement of any applicable laws.
17. The use of internet may be chargeable at the regular tariff rates. Consult beforehand with your service provider to know these charges. If entries are received for participation, it is assumed that the person sending in the entry has provided us with the permission to send him/her SMS/message on www.facebook.com or www.twitter.com or his/her E-mail to or call him/her, whether or not such sender is registered on the National Do Not Call Registry.
18. Winning entries shall be decided by PVM India/its Agency which shall be binding and non-contestable.
19. All entries sent by the Participant(s) would be received, monitored, verified, authenticated and stored by the PVM India/Its Agency in their computer systems.
20. Entries submitted by the Participants which do not comply with these terms and conditions will be rejected. PVM India reserves the right at its sole discretion to disqualify any such entry at any time.
21. Mere participation in the Contest does not entitle the participant to the prize(s) unless all other terms and conditions are fully met. Failure to comply with any of the terms and conditions hereof or any fraudulent conduct shall disentitle the participant.
22. By entering into the Contest and accepting the prize, the prize winner(s) waive all the copyrights, rights of publicity and any related rights and specifically consents to PVM India’s right to audiography, videography, picture, tape or portray him/her as a prize winner and to exhibit this material in any and all media now existing or hereinafter created, including (without limitation) television, film, radio and print media without any compensation whatsoever for such advertising and publicity for perpetuity, except where prohibited by law. The prize winner(s) also consents to PVM India’s unconditional right to use his/her name, voice or picture or the contents of his/her Contest entry/ post for perpetuity.
23. By participating in the Contest, each participant agrees to hold harmless PVM India and its affiliates, directors, officers, employees and agents, as well as all others associated with the development and execution of this Contest, from and against any and all liability with respect to or in any way arising from this Contest, the awarding and use, misuse or possession of the prize, including liability for personal injury, except where prohibited or limited by law.
24. PVM India reserves the right to change the terms and conditions of this Contest and to alter or terminate the Contest at any time without prior notice. An updated version of the terms and conditions will be available on the Mentos Facebook page or on www.mentosindia.com or 360game.mentosindia.com/terms/
25. PVM India/Agency shall not be liable for any failure to comply with its obligations mentioned herein, caused by weather conditions, fire, flood, hurricane, strike, war , riots, political unrest, civil commotion, terrorist attacks, or any other event amounting to Force Majeure and beyond their control.
26. The Contest is not available (void) where prohibited by any law. All relevant national and local laws apply. All disputes to be settled within the jurisdiction of the Courts in Gurgaon (Haryana) only.
27. By participating in the Contest, each participant specifically accepts as follows (a) that he/she has fully read and understood all the terms and conditions including but not limited to the Annexure I below, and be unconditionally bound by them b) that he/she satisfies the eligibility requirements under these rules c) that he/she unconditionally accepts the winners so selected d) that he/she shall honour all decisions of PVM India with regard to the Contest and its interpretation and not challenge them (e) to comply with all Central, State, Local Laws and Regulations.
28. User participating in the Activity in any manner shall be deemed to have read, understood and accepted the terms and conditions of this activity as well as Privacy Policy.
Annexure I
(“Steps on how to make an entry for the Contest through 360game.mentosindia.com/mentos360/”)
A. The journey of user/participant to participate in Contest:

Step 2: User sign-up for the contest by allowing Mentos 360° game application for permission on the www.facebook.com or www.twitter.com or www.google.com or by clicking on the confirmation mail link send to the users email address if the user registers for the contest via his / her mail.
Step 3 : A participant can participate in the contest as many time he wish but only the first three attempts of the participation will be considered towards establishing the shortest possible time in which the contest was completed by the participant. (i.e best of three attempts of participation)
Step 4: Out of all the eligible entries received, top 16 sixteen entries (arranged in ascending order of time in which the contest was completed) will be considered for prizes. Entries are judged by PVM India/Its agent basis the ascending order of time in which the participant completes the contest
Step 5: The selected winners will receive a message from authorized representatives of PVM INDIA and/or Agent asking them to provide their contact details. Any delay, in providing the requisite details, for more than 48 hours form the time of contact to the participant by PVM INDIA and/or Agent shall provide discretionary authority to PVM INDIA and/ Or Agent to consider another entry as a replacement prize winner.
